Special Note: American Health & Fitness urges all members to obtain a complete Physical examination from

their doctor prior to exercising or using any exercise equipment. All members should seek proper training on

how to use equipment since misuse can be hazardous. American Health & Fitness will not be liable for any

injuries sustained, including death or damage to personal property while on the premises of American Health

& Fitness, in the building, or while using equipment.


TERMS OF MEMBERSHIP AGREEMENT: You have the option to cancel this membership at the

end of your initial term agreement. To cancel your membership, you must give written notice 30 days prior to

your next draft or you will be charged for another month. Electronic Funds Transfer Membership (EFT) dues

will continue to be drafted at the end of your contract until cancelled and keys are returned. Your membership

card must be turned into MGMT and at that time you will be mailed your deposit if all keys are returned and

in sound condition.


CONSUMERS RIGHT TO CANCELLATION: This contract may be cancelled only under the following

terms and conditions: 1) American Health and Fitness goes out of business. 2) You die or become totally and

permanently disabled during the membership following the date of this contract. 3) You permanently relocate

your residence more than (50) miles from the facility. Customer will have to provide acceptable proof of

new residency. You will be responsible for all balances on account. Cancellation will not take affect if a

balance is owed.

 

Acceptable proof of Disability: A determination by the Social Security Administration for disability

benefits provides proof or a signed report from a licensed Doctor.


Acceptable Proof of Relocation: Acceptable proof of Relocation: 1) a utility bill from the new

address. 2) A phone bill from the new address. 3) A deed or lease agreement from the new address.


Liability Waiver: It is expressly agreed that all use of the fitness facility shall be undertaken by a member or

visitor at his or her sole risk, and American Health and Fitness shall not be liable for any injuries or damage to

any member or visitor or the property of any member or visitor or be subject to any claim, demand, injury or

damages whatever including without limitations. It is especially agreed that American Health and Fitness shall

not be responsible for liable to members or the guest for articles lost or stolen at the club. It is also agreed by

the member that he/she shall be responsible for any damages to the facility or property, or the property of any

third party, caused by the member of his/her family and any guest of there member of his/her family.


Additional Fees: Additional fees will be incurred for late payments and returned payments. In the event of

default in the payment of any sums specified, American Health and Fitness, at its opinion, demand immediate

payment of all balances. This facility reserves the right to terminate any membership upon violation of any

facility rules or regulations. Any claims for violations of any consumer protection laws made by the member

shall be limited to amounts he/she has paid under their membership agreement. Upon a Payment being more

than 5 workings days late the entry keys of a member may be turned off until payment is received.


Family Membership: Constitutes parent/guardian and children/legally adopted. Children 11 years and

younger will be able to utilize the facility only when special classes are taught, in specified areas, and when in

direct supervision of parent. Children under 11 are not allowed in weight area, or on any cardio or weight

equipment. Parents understand that American Health & Fitness does NOT provide any childcare

services, and/or daycare options. If parents choose to bring children under the age of 11, they must be

supervised at all times and are the direct responsibility of the parent. Any children allowed to be in the ladies

only area are to supervised at all times by parent, and must not be allowed to leave area without parent leaving

also.


Hours of Operation: Operating schedules will be subject to change from time to time. The facility, at sole

discretion of facility, may be closed on various Holidays.


Member Check in: All members and visitors upon entering the facility will be required to check in at the

front desk and or scan card at main entry.

 

Lockers: Lockers are available for temporary use while you are at the facility. No locks shall be put on the

lockers as a permanent situation. The member has the option for locker rental on a permanent basis by paying

an additional fee. Please see employee for rental information.


Guest Privileges: Guests are ONLY allowed with approval by management during staffed hours. Guest

must pay $10 per day for a guest pass or sign up for a membership. Members assume all responsibility for

guests. If members bring guests during non-staff hours and/or without approval, members may be charged

$10 per guest per incident. A member that allows a non-member to use their key or a member that opens the

door to allow a non-member to gain entry shall be considered a violation of guest policy and subject to $10

per incident being added to monthly membership fee.


Equipment malfunctions: Members understand that the equipment may periodically be inoperable.


Member Conduct: Pants or shorts, shirts and shoes are required at all times in workout areas. No clothing

with obscenities are allowed. Alcoholic beverages, illicit drugs, anabolic steroids, tobacco in any form,

smoking, and vaping are forbidden on the premises. Use headphones for music; No speakers or loud music

of any kind are allowed. Fighting, sparing and horseplay of any kind are strictly prohibited. Be respectful

and courteous to all other members and staff.


Incidental Programs and Services: Member acknowledges the purchase of a membership in a physical

fitness facility. The facility may provide programs, exercise classes, services or equipment related to fitness

and may not be required to continue any particular program or service as part of its contractual obligation

herein and may change or modify such programs at its discretion. Any classes taken by the member that are

held on the premises, even if provided by outsourced entities, are taken with the understanding that the member

is taking them at their own risk. Member agrees that now or at any future date, if any disputes arise over the

interpretation of this agreement, and/or any unresolved issues are to be handled first through mediation, and

then if they remain unresolved, arbitration.


Use of Tanning Beds: Use of the Tanning Bed/beds is at the sole discretion of the member. American

Health & Fitness makes no claim for the safety of the tanning beds and on how they affect the body both now

and in the future. American Health & Fitness is not liable for any accidents, burns, blemishes, or skin cancers

that could be or are caused by direct or indirect use of the tanning bed/beds.


Use of Men’s Sauna: American Health & Fitness is not liable for any problems or injuries caused by direct

or indirect use of the men’s sauna. The use is not required and is solely the choice of the member.


Use of Ladies only area: This area is provided for the privacy for ladies. Any accidents, injuries or

problems that happen while in this area to the member and/or any guests brought by the member including

children, are the sole responsibility of the member and the member will not hold American Health & Fitness

liable for such.


Amendment to Rules: American Health and Fitness reserves the right to change and/or add to these rules, as

it may be necessary for safe and proper management of the facility and its program.


Warranties: Member agrees that no warranties, representations, agreements, fitness for purpose or otherwise,

expressed or implied, have been made to member.
